Welcome to Your Energy Side. These Terms of Service ("Terms") govern your access to and use of the yourenergyside.com website and all related services (collectively, the "Service"). By accessing or using Your Energy Side, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Your Energy Side is a trust-first home remodeling blog and decision portal designed to help U.S. homeowners make informed decisions about energy-saving upgrades. Our Service provides educational content, comparison tools, cost calculators, and connections to local contractor offers. We aim to help you determine which energy-efficient improvements are worth pursuing for your specific situation.

The Service includes, but is not limited to: informational articles and guides about home energy upgrades, decision-making tools and calculators, user reviews and ratings, connections to third-party contractors and service providers, and community features for homeowners to share experiences. Your Energy Side reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts and Responsibilities

The Your Energy Side name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Your Energy Side or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on yourenergyside.com are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include any right to resell or commercial use of the Service or its contents, any collection and use of product listings or descriptions, any derivative use of the Service or its contents, or any use of data mining, robots, or similar data gathering and extraction tools.

6. User-Generated Content

Your Energy Side may allow you to post, submit, publish, or display content such as reviews, comments, questions, photos, and other materials (collectively, "User Content"). You retain ownership of any intellectual property rights that you hold in your User Content. However, by submitting User Content to yourenergyside.com, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

When you connect with contractors or service providers through yourenergyside.com, you are entering into a direct relationship with those third parties. Your Energy Side is not a party to any agreements between you and contractors, and we are not responsible for the quality, safety, legality, or any other aspect of services provided by third parties. You should conduct your own due diligence before engaging any contractor or service provider.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or discontinuing your use of the Service.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and the parties hereby consent to personal jurisdiction and venue therein.

You and Your Energy Side agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and Your Energy Side waive any right to a jury trial.

13. Changes to Terms of Service

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by posting the new Terms on yourenergyside.com and updating the "Effective Date" at the top of this page. We may also provide notice through email or through the Service itself.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service. We encourage you to review these Terms periodically to stay informed about our policies.

14. Miscellaneous

These Terms constitute the entire agreement between you and Your Energy Side regarding the use of the Service and supersede all prior agreements and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
